The words "you" and "your" shall mean Glow Financial Services Canada Corp. or its subsidiaries, as the case may be, and their respective successors, assigns, agents, and representatives. The words "I," "me," and "my" mean any person or entity that accesses or uses any page of the website that Glow Financial Services Canada Corp. or its subsidiaries, as the case may be, administers for in respect of its loan programs (the "Glow Customer Hub").
I understand that I should review the following Terms of Service carefully, because they govern my access and use of all materials, information, and services on each page of the Glow Customer Hub. If I access the Glow Customer Hub, I accept and agree to these Terms of Service. If I do not accept and agree to these Terms of Service, I may not access the Glow Customer Hub.
I understand and agree that these Terms of Service are in addition to other agreements, terms, authorizations, policies, and notices that apply to me in connection with your loan program, including those you provide to me when marketing, originating, and/or servicing any loan. If these Terms of Service conflict with your other agreements, terms, authorizations, policies, and notices, these Terms of Service will control solely as they apply to the Glow Customer Hub. These Terms of Service are not intended to modify any disclosures or other terms that are required by law. I may use this link to view information about how you collect, use, and disclose personal information about me in connection with the Glow Customer Hub.
I understand and agree my access to and use of the Glow Customer Hub is subject to applicable federal, provincial, territorial, and municipal laws and regulations. Unauthorized use of the Glow Customer Hub is prohibited. Violators can be prosecuted under applicable law.
Quebec Residents: These Terms of Service are a contract of adhesion. In accordance with the Charter of the French Language (Québec), you are entitled to receive these Terms of Service and related consumer documents in French; you may be bound by an English-language version only if that is your express wish after the French-language version has been made available to you. Nothing in these Terms of Service limits any right you have under the Civil Code of Québec to have an abusive, illegible, or incomprehensible clause in a contract of adhesion annulled or reduced by a court.

The information and materials on the Glow Customer Hub may not be copied, transmitted, displayed, distributed, downloaded, licensed, modified, published, posted, reproduced, used, sold, transmitted, used to create a derivative work, or otherwise used for commercial or public purposes without the prior written consent of Glow Financial Services Canada Corp.
Changes or Amendments
I understand and agree that you may change, suspend, or discontinue the Glow Customer Hub, or any of its features, at any time and without notice. I also understand and agree that you may amend these Terms of Service at your sole discretion by posting revised terms on the Glow Customer Hub. Unless otherwise indicated, when I use the Glow Customer Hub after the effective date of the revised Terms of Service, I accept and agree to the revised Terms of Service.
Termination
My rights under these Terms of Service will cease without notice if I do not comply with any of its terms. In such a case, I understand that you may immediately stop my access to and use of the Glow Customer Hub.
Notices
I understand and agree that you may provide me with notices related to the Glow Customer Hub by email, text message/SMS, regular mail, or postings on the websites or apps related to the Site. I understand and agree that my use of the Site is subject to the Consent for Electronic Records and Signatures disclosure and the Consent for Telephonic and Electronic Communications disclosure that provided to me during the loan application process. These disclosures allow you to provide me with certain communications and other records electronically.
Feedback
I agree that any suggestions, comments, and feedback I submit to you through the Glow Customer Hub ("Feedback") shall be your property. I agree you are free to use any of my Feedback, without restriction of any kind.
Disclaimer of Warranty
I UNDERSTAND AND AGREE THAT YOU ARE PROVIDING ACCESS TO THE GLOW CUSTOMER HUB ON AN “AS IS” BASIS. I UNDERSTAND AND AGREE YOU ARE MAKING NO EXPRESS OR IMPLIED WARRANTY OR REPRESENTATION. YOU DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. NO ORAL OR WRITTEN ADVICE OR INFORMATION GIVEN BY YOU CREATES ANY KIND OF WARRANTY NOT EXPRESSLY STATED IN THESE TERMS OF SERVICE.
I understand that the information contained on the Glow Customer Hub may include technical inaccuracies or errors. I also understand and agree that you may, from time to time, amend, change, add, delete, update, or alter the information contained at the Glow Customer Hub, without notice.
Limitation on Liability & Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, I ASSUME ALL RISK THAT MAY RESULT FROM MY USE OF THE GLOW CUSTOMER HUB AND ANY THIRD-PARTY SITES, INCLUDING LOSS ASSOCIATED WITH ANY COMPUTER VIRUSES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, I AGREE NOT TO HOLD YOU LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES RELATING TO MY ACCESS OR USE (OR INABILITY TO ACCESS OR USE) THE GLOW CUSTOMER HUB OR ANY THIRD-PARTY SITE, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES. IF YOU ARE DISSATISFIED WITH THE GLOW CUSTOMER HUB FOR ANY REASON, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING IT. TO THE EXTENT ANY LIABILITY CANNOT LAWFULLY BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY TO ME ARISING OUT OF OR RELATING TO THE GLOW CUSTOMER HUB, UNDER ANY LEGAL THEORY, SHALL NOT EXCEED TEN DOLLARS ($10).
Québec Residents: Nothing in this section excludes or limits your liability for moral injury or material injury caused by our intentional or gross fault, and nothing in this section excludes the legal warranty to which are entitled under the Civil Code of Québec or the Consumer Protection Act (Québec). This paragraph governs solely as applied to Québec residents, and only to the minimum extent required to comply with those laws, it does not otherwise narrow the exclusions and cap set out above.
Indemnification
I agree that I am personally responsible for my conduct while using the Glow Customer Hub. I agree to indemnify, defend, and hold harmless you and your respective owners, affiliates, directors, officers, employees, and agents from and against any claims, losses, expenses, liability, damages, and costs (including reasonable legal fees) arising out of (a) my use or misuse of the Glow Customer Hub, or (b) my violation of these Terms of Service, except to the extent caused by your negligence, wilful misconduct, or breach of these Terms of Service. This provision will survive the expiration or termination of these Terms of Service.
Governing Law
Ontario law, and the federal laws of Canada applicable therein, govern these Terms of Service, without regard to its conflicts of law principles. Notwithstanding the foregoing, if I am a resident of a province or territory of Canada, this governing law clause does not deprive me of the protection of any mandatory consumer protection laws that would otherwise apply in my province or territory of residence, including the Consumer Protection Act (Québec).
Severability
If any part of this Agreement is void or unenforceable, all remaining terms shall remain valid and enforceable.
Non-Waiver
I understand and agree that you shall not be deemed to have waived any of your rights or remedies, unless such waiver is in writing and signed by you. No delay or failure on your part to exercise any right or remedy shall be a waiver of that or any other right or remedy. A waiver on any particular occasion shall not be construed as a bar or waiver of any rights or remedies in the future.
